Terms as defined in this document:

• “We”, relates to Aethereal Stock Photo, aetherealstockphoto.com and its proprietor.
• “You”, the reader, potential consumer and account creator.
• “Users”, general website traffic, those who visit the website but do not make purchases, this also includes those who fit the definition of consumers and account holders.
• “Consumer”, any, non-commercial purchaser above the age of 18 form whom we provide products for personal use only.
• “Products”, the consumer products that “We” have made available for sale to “You”, the “Consumer”, are digital download files consisting of high-quality images intended for person use only.
• “Third-Parties”, any third-party entity such as the website hosting provider whom “We”, must also do business with in order to operate, provide and service the website: aetherealstockphoto.com.

Aethereal Stock Photo is the business name for the sole proprietorship owned and operated by the photographer Josiah S. Schroeder. The website aetherealstockphoto.com is the website that Aethereal Stock Photo created to function as an online market place and access point for “You” the potential purchaser of our materials.

The purchasable materials that we provide through aetherealstockphoto.com are digital download files of images that “We” wish to make available for sale to “You” in the form of consumer purchases, we currently do not offer commercially available products.

The consumer consists of any individual that is ages 18 or older, who would like to make a purchase and is willing to agree with and adhere to the Terms laid out in this document as well as the subsequent Privacy Policy and any other related documentation.

Terms and Conditions Modifications

We reserve the right to, at any given time for any given reason, modify our Terms and Conditions, Privacy Policy or Free-Use Licensing Agreement; in this event users will be notified within 14 days of the effective change date.

General

These terms along with the accompanying Privacy Policy and any other policy incorporated into these terms are the whole of the agreement made between the consumer and Aethereal Stock Photo.

As stated previously, we reserve the right to amend these documents at any time for any given reason and will notify users of the change within 14 days of the modification.

These terms may not be modified by anyone for any reason outside of Aethereal Stock Photo.

Digital Millennium Copyright Act

Aethereal Stock Photo and aetherealstockphoto.com, as well as the products provided therein are compliant with the digital copyright act in that all products made available are the original works and productions of Josiah S. Schroeder.

All necessary efforts shall be made in order to prevent any type of trademarking or copyright infringement, as opposed to attempting to circumvent such infringements.

Service Ownership

Aethereal Stock Photo and aetherealstockphoto.com are the property of Josiah S. Schroeder, I own the business, the website domain, am the creator and provider of the website content. I own the production equipment and original digital master files which are then edited for re-sale, nobody may use the content provided except as specifically permitted under the following Consumer Photo Licensing Use section of this policy and as defined in the Free-Use Licensing Agreement.

Consumer Photo Licensing Use

The images made available for purchase are intended for consumer purchase only, this means that a retail tax will be charged to each purchase, assessed via the billing address of the consumer.

The images available on aetherealstockphoto.com are sold as free-use consumer products, meaning that they can be used however the purchaser would like to use them. They are primarily intended for use as screensaver and background content but may be printed, re-processed or used in whatever way the purchaser can imagine; which does not result in the re-sale or recycling of the image for further commercial purposes. If users would like to contact us for commercial inquiries, then please feel free to do so, however at this time we are not offering such services.

Account and Purchase Eligibility

This website is intended for use by peoples who are 18 years of age or older due to the fact that a debit/credit card and a billing address must be provided to make purchases. People under the age of 18 must receive parental permission prior to purchase and the information provided must be the parental guardians.

Users may lose their eligibility status if they are found to have violated any article from these Terms and Conditions, the Privacy Policy or any related materials. Loss of eligibility status will result in loss of download library access.

Making Purchases and Data Collection

Consumers who would like to make purchases must abide by the articles laid out in these Terms and Conditions By making a purchase you agree to share the following information with Aethereal Stock Photo, aetherealstockphoto.com and any of their third party affiliates:

• The information listed under Accounts and Registrations for billing and account management purposes.
• Device and Internet Browser used to access the website domain and to which any purchases have been downloaded.
• IP Address used to access the website domain and download content.
• Any information provided by pre-attached cookies or other internet tracking mechanisms i.e., the cookies and tracking devices any consumer brings with them when entering the domain aetherealstockphoto.com.
• Any information provided by additional cookies or other internet tracking mechanisms utilized by Aethereal Stock Photo and aetherealstockphoto.com, i.e., any information provided by cookies or standard practice tracking mechanism that “We” may utilize.

These are standard practice data sharing information points and it is suggested for consumers who disagree with this information collection to choose to leave the website and refrain from making purchases.

Disclaimer; No Refunds

All sales are final, no refunds will be provided, if for some reason a registered user loses access to their download library, one free access copy will be provided.

We cannot process refunds after purchases have been made due to the immediate download access provided. Once a file has been downloaded, it cannot be “un-downloaded”, therefore once a purchase has been made, we cannot refund the file access granted.

The only refunds provided will be in any instance of known fraud.

Please thoroughly review potential purchases in the product page using the preview magnifier, if you are unsatisfied with the download purchased, please let us know and we may provide either an edited version or a substitution, the remedy provided will be evaluated on a case-by-case basis and no two remedies may be the same.

Accounts and Registrations

An account is not required for making purchases, purchases can be made through a “Guest Account”.

Guest account use will result in the collection of this consumer information and is subject to the same data-sharing policy as described in the Making Purchases Section of these Terms and Conditions:

• The information listed under Accounts and Registrations for billing and account management purposes.
• Device and Internet Browser used to access the website domain and to which any purchases have been downloaded.
• IP Address used to access the website domain and download content.

• Any information provided by additional cookies or other internet tracking mechanisms utilized by Aethereal Stock Photo and aetherealstockphoto.com, i.e., any information provided by cookies or standard practice tracking mechanism that “We” may utilize.

Users who create an account will receive life time and reasonably, unlimited download access. Abuse of the unlimited download privilege may result in loss of privileges and site-wide limited access for future consumers, don’t be the person to ruin it for everyone.

Users who complete the registration process promise that the information they provide is true and that they will keep the information accurate and up-to-date.

Information collected for Account Creation and Registration Purposes consists of:

• Name
• Phone Number
• Billing Address
• Payment Information

We are not responsible for password protection or suspicious account activities; however, we would be more than happy to assist in password resets and freezing account activity.

Account Access and Usage

Users who create and register for an account may receive lifetime access to any digital download files that they have purchased and registered under the account.

If you have purchased a digital download using the “Guest” account and can provide the relevant billing information; you may then later register an account with the website and we will unlock the previously purchased content under your new account. Please contact us with the related bill of sale information at:

The purpose of the user accounts is to allow consumer to update their account information, manage and access their download library.

Abuse of the lifetime and unlimited purchase download access can and will result: loss of download access, future purchase limitations, IP bans, account deletion, site-wide restriction. Please do not be the person that ruins things for everybody.

Prohibited Conduct

Any user attempting to interfere with the website security.

Any user attempting to interfere with the operation of the website.

Any user attempting to perform fraudulent activities.

The purchase and subsequent re-sale or recycling of materials from this site for commercial purposes.

Any Website Users or Consumers found in violation of any these prohibited conducts will lose access to the website as well as have their information sent to the appropriate authorities.

Account Termination

Violation of these Terms and Conditions will result in a direct account termination and subsequent loss of previous download access.

We are not responsible for refunding any users for loss of purchased materials due to the termination of an account.

Additionally, we reserve the right to terminate accounts and refuse to do business with any potential purchasers under any condition deemed reasonable by Aethereal Stock Photo.

Linked Website Content and Third-Party Services

Throughout the website aetherealstockphoto.com, there are linked content buttons that will re-direct users to the relevant social media pages, there are no other linked content sources on our website.

We are not responsible for maintaining, staying informed, or sharing the privacy and user content policies of these third-party services.

Privacy Policy and Additional Documentation

We may notify users of updates to the Privacy Policy, which is subject to change per the same right to modification as these Terms and Conditions. A notification of change will be released within 14 days of the change.

We are not responsible for people who choose not to stay up to date or review our Privacy Policy or these Terms and Conditions.

By agreeing to these Terms and Conditions the user agrees to a consent of communication via electronic means i.e., e-mail notification.

Governing Law, Dispute Resolution and Arbitration

Any disputes to be levied against Aethereal Stock Photo shall be held through binding arbitration.

Arbitration shall be held be a neutral third-party mediation entity in order to minimize costs to both parties, attempt to expedite a beneficial resolution and reduce the load on the criminal justice system.

Limitation of Liability

We are not responsible to users of the web market for any negative impacts that may arise from use of the provided website and its associated content.

Indemnity

The user is responsible for their use of the web market provide and we are not responsible for any claims, liabilities, damages, losses and expenses that may come from access to the market.
